Terms & Conditions
In an effort to produce the highest quality floors in a safe work environment, the following terms, conditions, and disclaimers are important and should be understood by the client and or his builder or agent designated to work on behalf of the client. If you have any questions, please ask for clarification.
Artistic Impressions (hereinafter referred to as AI) maintains a favorable relationship with our insurance company. To honor this relationship, we do not move appliances, building materials, furniture, fixtures or the like. Although we appreciate that time is of the essence, temperatures, unfavorable weather conditions, and unforeseeable factors may cause delays beyond the control of AI. We understand that rescheduling is sometimes unavoidable. However, we are often booked several months in advance. If your project must be rescheduled, please provide as much advance notice as possible that we may likewise accommodate your schedule. AI creates rich, custom floors designed with a project specific style in mind. Because acid stains chemically react to the mineral deposits of the concrete, each of the attributes and elements of the slab contributes to the finished floor. Each mix of concrete produces a unique design. Although the workmanship is guaranteed, the results are not. Unlike paints, subjugation of acid stains is not possible. They may be manipulated but not controlled. The results may be anticipated but not guaranteed. Neither the color, nor depth of color, the pattern nor the absence of patterns in the stain reaction is guaranteed. The results of the reaction are a mottled and variegated effect. Unique patterns occasionally appear due to factors (such as fly ash, accelerators, and extremely tight concrete) which are beyond the control of the applicator. The client should understand the nature of this process and be comfortable with the characteristics of stained concrete prior to the commission of any such work. The invoice is based upon work performed and not upon aesthetic results. In order to most closely meet and exceed our client’s envisioned floors, the client or his agent authorized to make final decisions on his behalf shall be available at various stages of the process. The floors evolve as we co-create in response to the various reactions chemically produced. A cementitious patching agent is available to compensate for surface voids of concrete or slight crust de-lamination in the areas specified for stain. Minimal surface flaws may be left unaltered. The patch, as well as any area in which the concrete surface is different than the primary surface, will react separately to the stain. If no patching preference is indicated in writing, the applicator shall patch as and if he deems appropriate. It is possible for the chemicals to “wick up” and affect woodwork, walls, surrounding floors and etc. Likewise, gusts of wind and other unforeseeable factors may contribute to over-spray. The client is responsible for “touch ups” or other remedies. Whenever possible, concrete staining should be done prior to any other flooring. AI specializes in acid staining only and water base staining only. We do not replace the trim or provide floor reducers or transition pieces. We do not construct or reconstruct anything. We just create exquisite floors! We are not responsible for moisture in, under, on, above, or around the slab or any other adverse element. AI is not responsible for non stainable surfaces i.e. a sealed or acid washed slab. In the unlikely event that the discovery of an unfavorable surface is made subsequent to the commencement of scoring and/or prep and the project, or a portion thereof, is aborted, 30% of the invoice for the unfavorable surfaces areas will be credited to the account as it applies to the non stainable areas. The stain is permanent. The sacrificial and protective topcoat is not. The wax and or sealer may need to be reapplied at some point in the future. The manufacturer recommends re-waxing at 6 months. Because we care about the welfare of our clients and other tradesmen, as well as the outcome of the floors, it is imperative that AI have sole access to the floors during the entire process. The client shall acquire permits/permission and confirm proper ventilation for the use of solvent products. Hazardous materials (health & fire) are used at different stages.
Additionally, it is necessary that no one step on the floors before they are complete and signed off as approved. Footprints may be permanently scarred into the floors. AI makes every effort to respect our client’s budget. Our proposals never assume costs not yet presented. We do not assume avoidable expenses such as cleaning paint over-spray or supplemental sealer applications. In order to prevent avoidable expenses, the Builder’s Instructions (included herein by reference) should be read, understood, and followed. Any alteration from those instructions will affect the outcome of the floors. In the event that such alterations or other unforeseeable factors cause additional expenses (i.e. labor, materials or service trips) to be incurred by AI, an appropriate surcharge shall be assessed.
A clean floor is extremely important. The client and or the builder shall cover the floors and maintain such covering according to the aforementioned Builder’s Instructions. The floors should be aggressively protected from the following which can adversely and irreparably affect the outcome: Cure and/or Seal, bond breakers, muratic acid, chemicals, tape, paint, silicone products, markers, crayons, grease sticks and the like. Do not add fly ash or accelerators to the concrete batch. Contamination or damage by other trades to the floors, which was not included in the standard fee, will be billed according to the extent as well as the remedial steps required.
The client may select the scoring pattern. However, AI reserves the right to adjust the block sizes, placement and banding as the area dictates. Scoring is an art of precision. Occasional imperfections, although rare, do occur and shall be tolerated. The industry standard for area calculations is just as the architect and appraisers measure- wall to wall including cabinets, walls, and etc.
For the safety of all involved, no cigarettes, pilot lights, or any other source of ignition shall be present at any time of the AI process. You may re-light them upon the conclusion of the process. It is advised that all vehicular traffic be restricted from sealed surfaces for 3 (three) days or until the sealer is sufficiently dry. The price quoted is based upon up to 2 (two) coats of stain (if applicable), two coats of wax (if applicable) and up to two coats of sealer (if applicable). One is typically sufficient. Should additional coats be necessary, they are applied at 50 cents per coat per square foot. Supplemental cleaning at the final or any stage of construction is not included in the price unless stated and itemized on the invoice. Should cleaning beyond initial and basic prep be desired or needed, a supplemental invoice shall be paid by the client. Payment terms are: 50% non refundable deposit due at scheduling and the remaining 50% plus any add-ons due at staining unless noted that payment is due upfront. Past due accounts are subject to late charges and interest. All returned checks are subject to a $45 service charge in addition to all consequential bank fees. All parties agree to arbitration in the event of any dispute. In no event and under no circumstances whatsoever shall Artistic Impressions be liable beyond the paid amount of the invoice. Artistic Impressions does not warrant the merchantability of the floors. No warranties express or implied, are made.
